1 seller, 1 set of terms for every title on the site, prices as shown, a contract only when the parcel leaves, and Tennessee law after 30 days of email. That is the agreement in 1 sentence, and each of the 13 sections below is a sentence you can hold us to. These terms include the Shipping Policy and the Refund and Returns Policy, plus the Payment Policy and the Privacy Policy; where any of them gives a number, that number governs.

You accept these terms by ordering

What counts as agreeing. Placing an order, opening an account or posting a review; browsing binds you to nothing, so read the shelves for as long as you like before any of this applies to you. The version that applies is the version live when the order went in, and the date under the title tells you which that is.

What is not in here. No arbitration clause, no class-action waiver and no fee-shifting trap; a disagreement is handled the way section 13 says, starting with an email. Read it. It is short.

You are buying from KENNETH COLBAUGH LLC of Decatur, Tennessee

The legal seller. KENNETH COLBAUGH LLC, a Tennessee limited liability company trading as Ainekay, Employer ID 99-4178666, registered office 1015 Sneed Rd, Decatur, TN 37322, United States. That company is the merchant of record for each order placed here, with no marketplace in between, and Ainekay hosts no third-party sellers, so every order on this site is a sale by KENNETH COLBAUGH LLC to you. 1 company, 1 address, 1 shop.

You are 18 or older, ordering for your own use

The minimum age. 18, because an order is a contract; a 16-year-old with a parent's card is the parent's order. We do not check ages at the door. We rely on this sentence and on the card holder.

Where you can be. Anywhere; where the parcel can go is the 48 contiguous states and DC, and gifts are fine there: ship to any qualifying US address and put the recipient's name on it. Bulk or resale orders need a question first, because the flat $4.99 and the stock behind each title are sized for households.

You are looking at 30 books today; anything added later sells on the same terms

Today. 30 printed books on 3 shelves: cooking and baking; garden and growing; crochet and knitting. Every copy is new, from the licensed wholesalers that supply American bookstores, packed by a US distribution partner.

Later. If the list grows, a new title or a new shelf is sold on this page's terms and on the 4 policies from the day it is listed, and where the policies say "book" they mean whatever you ordered, from whichever shelf. The list may grow, and it will grow in the open, because the About page and this section change when it does. Never quietly.

You pay the price shown, and a wrong price is cancelled and refunded, never enforced

The price. The figure shown on the book's page when you order, in US dollars, and checkout adds $4.99 shipping under $35 and sales tax at your state's rate, nothing else. A price change reaches only orders that come in after the change; an order already in keeps its price.

A wrong price. If a typo shows $2.99 for a $23.99 book, we cancel, refund in full and tell you why; we do not ship at the wrong price and we do not hold you to the right price. No crossed-out prices, because no book here has ever had a higher price to cross out, and a discount code, when a code exists, is the only thing that lowers a price. Nothing else does.

You have a contract when the parcel leaves, and 12 hours before that to change your mind

An order becomes a contract in 3 steps, and you can step out of it for the first 12 hours at no cost.

1. When you place an order you receive a confirmation email; that is a receipt of the order, not yet acceptance.
2. Payment is charged when you confirm; methods and holds are in the Payment Policy.
3. The contract is formed when the distribution partner hands the parcel to USPS and the shipping email goes out. Not before.

Your window. 12 hours from the confirmation email, by email, with a full refund. Our window. Until dispatch, for a mistaken price, a sold-out title, an address outside our delivery map, or a payment the processor flags; always refunded in full, always with an email. Between the confirmation email and the shipping email the order is a request we are working on, which is why cancellation inside 12 hours costs nothing, and why an order we cannot fill is refunded, never substituted.

You get 3 to 9 business days of shipping and 30 days of returns, priced in the 2 policies

Delivery. 1 to 3 business days of handling plus 2 to 6 with USPS, with a 4:00 PM Central cut-off, to the 48 states and DC; the details are in the Shipping Policy. Risk of loss stays with us until USPS records delivery at your address, and title passes to you on delivery, once the order is paid. A lost parcel is our loss.

Returns. 30 days from delivery with $0 restocking, and the postage rules by scenario are in the Refund and Returns Policy. No number lives on this page alone. Each is copied from the policy that owns it, and if this page and that policy ever disagree, the policy is right and this page gets corrected.

You may not copy this site, and you can report a copy of your own work

Whose is whose. Ours: the product descriptions and the page text, the logo, the photographs we made. The publishers': cover art and book titles, used here to sell their books, as any bookseller does; a cover image is the publisher's property and we show it the way every bookshop does, to identify the book, and a publisher or author who wants a cover removed gets it removed. Same business day.

Your license. To read the site, print a page for your own use and share a link; copying our descriptions or photos into another shop or listing is not licensed.

A complaint about your own work. Copyright complaints under the DMCA go to [email protected]: name the work, show you own it, give the URL here that copies it, and say how to reach you; we answer within 1 business day and take down what is shown to infringe.

You write reviews only about books you bought here

Who can post. Only someone who bought that title from this site. We never pay for a review, write a review ourselves or ask a friend to; the Federal Trade Commission's Consumer Reviews Rule forbids it and so do we.

What happens to it. Before a review appears, a person checks it for spam and for anything that is not about the book, and negative reviews are published on the same footing as positive reviews. A 1-star review stays up. Your license to us is to display the review under the book, signed with the name you chose. A review count of 0 on a new shop is the honest number, and it will stay 0 until a real reader writes a review. Better that than a wall of borrowed praise.

You use the site for shopping, and 5 things are off limits

Here are the 5.

1. Copying the site's text or photos, by hand or by script, for another shop.
2. Probing, overloading or attacking the server.
3. Ordering with someone else's card, or under a false name.
4. Posting a review for pay, or about a book you did not buy here.
5. Using the contact form to send advertising.

An account that does any of the 5 is closed, an order placed that way is cancelled and refunded, and where a law is broken the record goes to the people who enforce it.

You get the warranties the law gives, and our liability stops at the order value

What we warrant. That the book is new, is the ISBN and format on the product page, and arrives undamaged, or the returns policy applies. We do not warrant the recipes, the patterns or the planting advice inside; the site being online every minute; or a cover matching the photo when the publisher changes it.

The ceiling. What you paid for that 1 order, books and shipping. Outside the ceiling sit indirect loss and lost time, plus anything that follows from acting on a page inside a book; where your state's law grants a warranty or forbids a cap, it wins over this section. The implied warranties that a state's commercial code adds, merchantability and fitness among them, are disclaimed as far as Tennessee law allows; that is the standard sentence, and the plain version is the first sentence of this section: a bookshop stands behind the book as an object, not behind the advice printed in it. That is the whole warranty.

You cover costs your own breach causes, and a struck clause leaves the rest standing

The indemnity. Narrow on purpose: it reaches a scraper or a fraud, not a customer who returns a cookbook. If a breach of section 10, or an unlawful use of the site, lands a claim on us, the reasonable cost of answering it is yours.

The housekeeping. A court that strikes 1 sentence here leaves the other sentences in force; these terms and the 4 policies they name are the entire deal, and nothing said in a chat window or an email adds to them unless it is written into this page; letting 1 breach go does not waive the next. None of this is hidden.

You and we talk for 30 days before any court, under Tennessee law

The law. Tennessee, without the state's conflict-of-laws rules, and a dispute goes in 3 steps.

1. An email to [email protected].
2. 30 days of good-faith exchange before anyone files anything.
3. After that, a state or federal court for Meigs County, Tennessee, unless a consumer law in your own state gives you a court closer to home, which it may.

When these terms change, the "Last updated" line moves, and an order that is already in keeps the wording of its day. Questions go to the desk below. In practice a dispute about a $23.99 book ends with a refund and an apology inside the 30 days, and the court sentence is there because a contract has to name a court. Nothing more.
